Old visa holders have access to four different permanent visa pathways to apply for PR visas.

Before the business innovation and investment 188 visa, 888 visa and 132 visa are introduced to applicants by Department of Home Affairs, there are six old business visa subclasses. For those old visa holders, they can still access four different permanent visa pathways to apply for PR visas.

In order to access the PR pathways, you must hold the following visas:

  • Business Owner (Provisional) visa (subclass 160)
  • Senior Executive (Provisional) visa (subclass 161)
  • Investor (Provisional) visa (subclass 162)
  • State/Territory Sponsored Business Owner (Provisional) visa (subclass 163)
  • State/Territory Sponsored Senior Executive (Provisional) visa (subclass (164)
  • State/Territory Sponsored Investor (Provisional) visa (subclass 165)

The four PR pathways are:

  • Business Owner (subclass 890): This 890 visa is for applicants who currently hold any of the 160, 161, 162, 163 , 164 or 165 visa. The applicants must also have lived in Australia for 1 year cumulatively; and still own and manage a business for 2 years in Australia.
  • Investor visa (subclass 891): This 891 visa is for applicants who currently hold 162 visa, and have lived in Australia for 2 years cumulatively. The applicants must also have held the designated investment of AUD1.5 million for at least 4 years continuously.
  • State or Territory Sponsored Business Owner visa (subclass 892): This visa has the same requirements as 890 visa, expect 892 visa requires applicants to be sponsored by the regional authority in the state or territory where you conduct your business. 
  • State or Territory Sponsored Investor visa (subclass 893): This 893 visa is for applicants who currently hold 165 visa, and have lived in Australia for 2 years cumulatively. The applicants must also have held the designated investment of AUD750,000 for at least 4 years continuously. The regional authority in the state or territory in which applicants have lived for at least 2 years must sponsor them to apply for an 893 visa.

Business Innovation and Investment (Permanent) visa Subclass 888

The 888 visa is the permanent visa pathway for 188 visa holders, it allows entrepreneurs, investors, and business owners to continue their activity in Australia permanently. The 188 visa holders can apply for the visa once they meet the requirements for the chosen stream, normally a 188A holder needs to apply 888A, 188B holders needs to apply 888B and so on. The 888 visa has no points test requirement.
Although, each of the five streams has its unique requirements, there are still some common 888 application requirements:
  • Have at least functional English Level (IELTS 4.5; PTE 30)
  • Submit their expression of interest to Australian state or territory prior to visa application.
  • Be nominated by Australian state or territory to apply
  • Conduct legal business and investment activity only in Australia.
  • Maintain business or investment when held Subclass 188 Business Innovation and Investment (provisional) visa
  • Meet residence requirements.
Business Innovation and Investment (permanent) visa (subclass 888) features:
  • Maintain business and investment activity in Australia permanently.
  • Include your partner or children into your 888 visa application.
  • Sponsor parents to apply for PR visa.
  • Stay in Australia permanently.
  • Access to Medicare and Centrelink payment.
  • Become Australian Citizen if meet requirements.

Basic Eligibility

You must:
  • hold a relevant stream of the subclass 188 visa or in relation to applications for a subclass 888 visa in the Business Innovation stream, hold a relevant stream of the subclass 188 visa, or a subclass 444 (Special Category) visa, or a subclass 457 (Business (Long Stay)) visa granted in certain circumstances.
